Terms and Condition
"Agreement" means the Terms and Conditions contained herein along with the Privacy Policy under the Fomber.com brand name. It will also include references to this Agreement as and when amended, supplemented, varied or replaced.
"Site" means the Fomber.com online platform owned and operated by Orchid Consulting Group LLC, New Jersey, US to use different custom related information through Fomber.com platform.
"Profiles" means any photos/portfolios/videos/features displayed on Fomber.com as posted by the user.
"User" means and includes any surfer/site visitor/marketers or you (the person or any legally recognized entity) who accept the services through Fomber.com by placing any Blogs, Videos, Photos, Features/profiles, Services, Virtual office, Market property.
"Visitor" means any individual registered on the site with an individual page, who shares information or establish networking or have access to any discussion, articles, news, blogs and videos on the site.
"Services" means i) free of cost services to the individuals who shares the information ii) platform provided for surfers at free of cost iii) Chargeable Ad. Services iv) Specific and chargeable deeds carried on by Fomber.com through its Virtual office platform.
Fomber.com reserves the right to accept or reject your offer. Services/profile/products and information displayed on Fomber.com constitutes an "invitation to offer". The agreement between you and Fomber.com shall be subject to the following terms and conditions:-
- The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian. Minors defined to be child by law of any nation are not eligible to use this site. Fomber.com in one or other way shall be no liable for any impact left by the information supplied by the users /visitors.
- These terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms & conditions. By using the Fomber.com you agree to be bound by the Terms and Conditions.
- Any articles, profiles, discussions, videos, Properties for sales and rent, albums posted/ uploaded on the site are the sole properties/ownership of the “Users”. Fomber.com doesn’t take any responsibility on the content, message they may leave or make any impact on the privacy or secrecy of any group/class.
- Fomber.com in any or other way cannot be responsible and liable for the accuracy and authenticity of any information posted or uploaded by the visitor. Fomber.com doesn’t mediate, facilitate or resolve any disputes, conflicts and misunderstanding if arose among the professionals, cross cultural, religious, ethnic groups in variation of information or misinterpretation of available information.
- The users remain fully responsible for any information posted, uploaded or displayed on the site. Accuracy, credibility and authenticity are upon the responsibility of the users. Fomber.com strongly encourages the users to share true & authentic information regarding profession, services, contact information and other information. In spite of its principle to avoid conflict, if rose any or such dispute between and among any group/class/professionals then Fomber.com will not initiate to settle such conflict or disputes.
- Fomber.com aims to provide only platform to share, learn, post marketing information, services, Real Estate Services and other support services with special focus on professional networking & promote their business. It won’t mediate between or among any groups.
- All payments/charges/fees unless indicated otherwise are in US $.
- Fomber.com cannot accept any information supposed to be conflicting, inappropriate or violating the copyright and professional ethics.
- Fomber.com reserves the right to refuse, alter or cancel profile that is listed inappropriately, or violation of any terms and condition of the Fomber.com.
- Fomber.com shall not be liable for any delay / non-delivery of the services due to internet connectivity, server problems or any cause that is beyond the control of Fomber.com.
- The User expressly agrees that the use of service(s) of Fomber.com is at the User’s sole risk. The Service(s) of Fomber.com is provided on an "as is" basis without liabilities of any kind, whether express or implied. Fomber.com its affiliates, employees, agents, consultants, contracted companies make no liabilities of any kind, whether expressed or implied, for the service it is providing or as to the results that may be obtained from use of the Service, or as to the accuracy, reliability or content of any information, service provided through this site. Fomber.com does not represent or warrant maintaining the confidentiality of information; although Fomber.com’s current practice is to utilize reasonable efforts to maintain such confidentiality.
- Notwithstanding anything contained herein Fomber.com acts only as a site provider to facilitate / integrate profiles and services as provided by informers through various platforms (online web store, print ads, call centre, mail order catalogues, SMS. etc.) for various viewers and shall in no way be responsible for any accuracy of information provided by either party. In no event shall Fomber.com, its directors, officials, representatives and employees be liable for any impact left by informer’s sharing.
- Presently, the service(s) of Fomber.com are being offered free for viewers only. Marketers and who want to take the service from Virtual office are charged for their services on using the platform. However, Fomber.com reserves the right to charge a fee for any or such facilities for the viewers any time without consent of stakeholders.
- The User agrees to use the services provided by Fomber.com, its affiliates, consultants and contracted companies, for lawful purposes only. Fomber.com won’t accept any products/services/offers labeled illegal by the existing law of any nation.
- The User agrees to provide authentic and true information. Fomber.com reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly), Fomber.com has the right in its sole discretion to reject the registration and debar the User from using the Services of Fomber.com platform, and / or other affiliated websites without prior intimation whatsoever.
- Fomber.com will not be responsible for any damage suffered by users from use of the services on this site. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the user. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, torturous behavior, negligence, or under any other cause of action.
- THE USER EXPRESSLY AGREES THAT THE USE OF SERVICE(S) FOMBER.COM PLATFORM IS AT THE USER'S SOLE RISK. THE SERVICE(S) OF FOMBER.COM PLATFORM IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. FOMBER.COM, ITS AFFILIATES, EMPLOYEES, AGENTS, CONSULTANTS, CONTRACTED COMPANIES MAKE NO WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, FOR THE SERVICE IT IS PROVIDING OR AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICE, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR PRODUCTS PROVIDED THROUGH THIS SERVICE. FOMBER.COM DOES NOT REPRESENT OR WARRANT TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION; ALTHOUGH FOMBER.COM CURRENT PRACTICE IS TO UTILIZE REASONABLE EFFORTS TO MAINTAIN SUCH CONFIDENTIALITY. IT IS ALSO CLEARLY UNDERSTOOD THAT ALL WARRANTIES, IMPLIED OR EXPRESS TAKE PLACE BETWEEN THE USERS.
